Big Win for Pro Bono Client at the Employment Tribunal

Acting through the charity Advocate, Fen Greatley-Hirsch has successfully represented a teacher with a rare bowel condition in her claims against her former employers, a primary school and its Local Authority.

Following a 6-day final hearing at Liverpool Employment Tribunal in November 2020 and panel deliberations in March 2021, the Tribunal has issued reserved judgment for the Claimant, in which all three claims – unfair dismissal, disability discrimination, and failure to make reasonable adjustments – are well-founded and succeed.

Issues in the case included the Claimant’s disability, the Respondent’s knowledge of that disability, and the length of time for which the Respondent could reasonably have been expected to wait before dismissing.

The matter will now be listed for a remedy hearing.
