Paul Canfield Successfully Appeals Conviction in a Failing to Provide Information as to Identity of Driver Case

Paul Canfield, instructed by Highgate Solicitors, represented a defendant who had been convicted following a trial in the Magistrates’ Court for failing to give information under Section 172 of the Road Traffic Act 1988.

The defence case focussed on the statutory defence arising through the second limb of Section 172(7)(b) of the Act, namely that it had not been reasonably practicable for the defendant to give the information as required under the Act.

During the appeal, the court heard that the defendant had experienced issues receiving mail following the removal of his letter box, house sign and the withholding of post by his landlord during a tenancy dispute. As a result, the court quashed the defendant’s conviction.
