Broadway House Chambers has a multidisciplinary Sports Team experienced in representing commercial entities, governing bodies, teams and individual athletes across a wide range of sports disputes and specialist practice areas.


Commercial & Contractual


Broadway House Chambers boasts a team of highly regarded employment and civil practitioners who are comfortable providing sports focused advice and representation across the whole range of employment and other contract disputes. Members of Chambers regularly appear in the Employment Appeal Tribunal, High Court and the Court of Appeal.


Recent examples of work undertaken by Chambers include:

  • Representing an RFL club in a dispute with a player alleged to have breached his playing contract by having unauthorised dealings with a competing club.

  • Representing a PGL professional in relation to a worker status, holiday pay and unfair dismissal claim.

  • Representing an RFL performance director in a breach of contract and unlawful deduction of wages claim.

  • Representing a high-profile professional football player in a claim brought by his former agent in respect of unpaid commissions.

  • Representing a professional footballer in a claim against him by a sponsor for breach of the sponsorship agreement.

  • Advising an endurance athlete on a high value appearance and image rights agreement. 

  • Advising on arbitration and alternative dispute resolution proceedings.


Disciplinary & Regulatory


Drawing on the strength of our Criminal and Regulatory Team, Chambers is regularly instructed across a wide range of disciplinary and regulatory work including:

  • Representing individual athletes accused of on and off field rule infringements before sports specific citing committees and Sports Resolution UK.   

  • Challenging Olympic and other major international selection decisions.


Anti-doping


The Team has specific experience in:

  • Advising on and challenging alleged whereabouts breaches.

  • Securing significantly reduced sanctions in cases of no or no significant fault.

  • Securing significantly reduced sanctions in recreational drug use cases with compelling personal mitigation.

  • Appearing before Sports Resolution UK in the first UK blood passport case.


Immigration


Drawing on the strength of our Immigration Team, members of Chambers are expert in advising and representing professional attempting to secure permission to live and work within the U.K.


Education


Members of Chambers have, over several years, worked with various sports clubs delivering player education in relation to understanding of the criminal law.

The Team below is able to provide player education across a wide range of disciplinary, anti-doping, criminal and safeguarding issues.   


 Intellectual Property


The Team provides advice and representation to individuals, companies and representative bodies of rights owners and their members in intellectual property cases relating to copyright, trademarks, passing off, registered designs, design rights, trade secrets, confidential information, unfair competition sports and character merchandising, corporate sponsorship and performer’s rights.


Privacy and Defamation / Media Law


In the light of the ever growing digital media and instant publication via social media and weblogs, protecting the privacy of your clients and others and ensuring that we do not unintentionally commit acts of defamation in increasingly important.

Ian Miller, a member of Chambers who has been researching and teaching the laws of privacy, defamation and media law in the digital age at a university for several years and is now taking instructions in the following areas:

·       Breach of Confidence (and confidentiality)

·       Misuse of Private Information and how to protect privacy

·       Defamation (libel and slander)

·       Advice on publications, press releases and websites to as to ensure privacy is maintained, consents received and material published is not defamatory.
