Private and Public (Care) children law cases

Led in a four and a half week Threshold and welfare hearing, before a s.9 Judge, acting for a Local Authority where findings sought were made relating to historic and recent sexual harm on children and exaggerated illnesses.
Being led in a lengthy Finding of Fact hearing involving sexual abuse. Successfully represented the father after further representations being made the court changed course to not make the most serious findings (having previously done so). Also, issues involving the flagrant breach of ABE and child protection policy guidance.
Four week Finding of Fact hearing representing the Guardian involving multiple allegations of inter and extra -familiar historic child sexual abuse. Judgment and reasons expanded upon following Court of Appeal ruling.
Three week finding of fact hearing representing A Local Authority involving multiple serious bruising. Despite admissions by a parent findings were made.
Finding of Fact hearings involving non accidental injuries, such as multiple bruising, burns, biting, broken limbs, ribs and skull fractures. These naturally involved extensive cross examination of medical experts.
Lengthy Finding of Fact hearing involving 17 children acting for an intervener who was alleged to have attempted to kidnap a family member for the purposes of aiding and abetting a forced marriage. There were overlapping Public Law Proceedings. Christian successful secured the dismissal of the application and interim orders. No Care Proceedings were initiated.
Cases involving allegations of fabricated / fictitious illness. This includes currently being led in a lengthy case where these issues are live.
Numerous cases where children and vulnerable individuals have given evidence.
Cases involving the diagnosis of Psychological and Psychiatric disorders.
Cases where instructed by the Official Solicitor.
Numerous cases involving allegations of emotional and physical harm and neglect.

- Re C and S - 6 weeks finding of fact hearing for a father involving multiple allegations of sexual and physical harm. Covert recordings raised.
- Re W, J and F - 3 weeks finding of fact hearing for a father involving bruising. In this case there were several intermediaries and significant mental health issues.
- Re H - 4 weeks finding of fact hearing for a father facing serious allegations of sexual harm. No findings made and application for care orders withdrawn.
- Re T - 6 week finding of fact hearing (High Court) for a local authority involving issues such as FII, failure to thrive, fractures and deliberate tampering with medical equipment on a child. Findings made.
- Re B - 5 weeks threshold and welfare hearing (High Court) for a local authority involving multiple subdural and retinal bleeds and fractures. Seven medical experts gave evidence including a geneticist because of a chromosome deficiency and whether a propensity to injure more easily. Findings made of a shaking type injury and blunt force trauma.
Financial Remedy / Trusts of Land:
- Re G and P - 6-day hearing (High Court) for an intervener facing an application pursuant to s.37 MCA 1973. Application dismissed following successful argument that the properties and businesses were held by the client pursuant to beneficial interests. No reviewable dispositions. Substantial costs order made in the clients favour on the indemnity basis.
- Re D and W - 4-day hearing for another intervener facing a s.37 application. Christian successfully argued the properties were legally and beneficially held by the intervener. No reviewable dispositions. Application dismissed and costs awarded on the indemnity basis such were the adverse findings against the applicant.
- Several cases involving Edgar v Edgar binding agreements prior to financial remedy proceedings, pre-nuptial agreements and challenges to valid Declaration of Trusts (including proprietary estoppel issues).

Emma McIlveen is a specialist employment disputes barrister, providing strategic advisory and advocacy services to respondents and claimants. She has represented clients in all types of employment disputes and has a particular interest and experience in:

Emma has extensive employment law experience and has appeared in the Employment Tribunal, Court of Appeal and in front of Regulatory Panels. Emma represents both claimants and respondents and has acted as sole counsel in a wide range of matters including complex discrimination matters dealing with disability, age, race, pregnancy and sex discrimination. She also has experience of handling claims for unfair dismissal, discrimination by association, unfair recruitment and selection procedures, TUPE and unlawful deduction of wages. Emma has represented claimants on behalf of the Equality Commission and successfully secured one of the highest awards for injury to feelings for pregnancy discrimination in Northern Ireland. Emma’s passion for immigration work started when she worked in the Harvard Immigration and Refugee Clinic in Boston. During her time at Harvard, Emma also travelled to Jordan to conduct an assessment of the Syrian Refugee Crisis. Emma now regularly appears before the Immigration Tribunal (both Lower & Upper Tier). Emma provides advice and representation across all areas of immigration and asylum law. She has a wide range of experience in this area and undertakes asylum appeals, deportation appeals, EEA appeals, unlawful detention claims and complex bail applications.
